#micropoetry "Diseased Monster"

The monster has a large mouth.
And a city sits in the middle of it
unaware of the jaws it inhabits.
But the monster's jaws will close
and chew it up with its worn teeth.

The law is slow #lawyerslife

While I signed up a personal injury and workers comp client today, he talked about how long everything takes.  And it does.  There are a number of reasons for this.

First, in both PI and workers comp cases it is necessary for an individual to reach "maximum medical improvement" meaning: get as well as possible.  This is so that the claim is settled AFTER all surgeries and major medical treatments are done.  You wouldn't want to settle, need a surgery and have to pay for it out of pocket.

Second, there are many cases.  Insurance companies are large and have entire departments devoted to claims.

Third, lawyers and theirs staffs are busy.  Legal proceedings take quite a bit of time and are work intensive.

These aren't the only reasons, but they are some of them.

#LavoyFinicum raises interesting terrorism questions

He died Tuesday in a standoff with the federal government.  Ammon Bundy was arrested in the standoff.  Some say Finicum was murdered.  Some say he was a domestic terrorist and was killed for national security reasons.  What do you think?

#Blizzard2016 pretty uneventful in my part of North Carolina

Yet the governor declared a state of emergency.  It was bad for this guy though.  I hope he remembered his 1995 Baja too.

Beware of #IRS e-mails

It is that time of year again: TAX SEASON, which is fast approaching.  "The horror, the horror," said Kurtz in Joseph Conrad's famous work, Heart of Darkness.  The real horror, however, is believing an e-mail from the "IRS" and supplying your personal information to whatever entity sent the e-mail.  If you fall for this scam, then your "horror" will be identity theft.  And that's worse than Kurtz's realization that darkness dwells in all of us or at least it is at a practical level.

#Snow from today (although melted) is likely to cause people to stay home on Monday

And why is that?  People will use any excuse possible to stay home from work.  Your unfounded fear is no reason to miss work, however.  Quite frankly, it isn't a "fear" at all but a stupid excuse to not go to work.  And that's likely because you are lazy.  If you stay home tomorrow, you should lose a vacation day or have your pay docked.

#LawrencePhillips death brings home mental health issues-- #braindamage while playing in the #NFL ?

I remember watching Lawrence Phillips play football.  He was great.  Such a talent.  Eventually Phillips served time in prison though.  And he died in prison.  He killed himself, and he likely did so due to mental health issues caused by injuries he sustained playing football.  You can't take that kind of abuse and not have mental health issues.

Phillips went to prison on a 31-year sentence for domestic violence.  Then he was accused of killing his cell mate and faced first degree murder charges.

I am going to start a #podcast called "Legal Fiction" sometime in the next few months #lawyerslife #legalpodcast

The show will cover legal fiction such as Grisham, Martini and others.  In addition, I will talk with other lawyers about creative writing and writing articles for publications.  It should be fun.

#guncontrol executive order

It is happening.  Finally something.  Congress didn't act.  If you are opposed to background checks and restrictions on owning guns, you shouldn't own a gun.

Good @Slate article on why you shouldn't post ANYTHING about your kids

Data miners are everywhere.  As Louis CK says, "Once you have a Social Security number, you are on the grid."  And that's true.  But putting your kid's image out there or naming your child exposes them to risk.  It is important to protect children, who are the most vulnerable in our population from predators.

NC General Assembly Passes New Law to Protect People with Disabilities and Children from Identify Fraud (House Bill 607)

On January 1, 2016,  a new law went into effect creating protection from identity theft  for children under the age of 16 and people with disabilities.  Because children and disabled individuals are particularly vulnerable it makes sense to extend protection to this group of consumers.  So-called “protected consumers” can request (through their authorized person) that a credit reporting agency (Equifax, Experian or Trans Union) place a security freeze on their credit report.  Parents or other individuals with sufficient proof of legal authority may present evidence of that authority such as a birth certificate and sufficient proof of identity such as a Social Security card in order to begin the freeze. This involves filling out a form, paying a small fee ($5.00)  and sending the proof of authority and identification to the General Assembly. http://www.ncleg.net/gascripts/BillLookUp/BillLookUp.pl?Session=2015&BillID=H607

One important thing to note: this “freeze” must be lifted at a later date.

On December 30, 2015,  Attorney Michael Wells appeared on WXII Channel 12 and provided insights to this new law. http://www.wxii12.com/news/protecting-your-childs-credit/37200544.

#OregonUnderAttack is #domesticterrorism

When several armed  white Americans raided and took over an Oregon federal building, it was terrorism.  These men from within are the true enemy.  I hope the FBI and US Marshalls get them.  They deserve it.
