#SugeKnight involved in an alleged hit-and-run

In Compton.  He is the Death Row Records founder and the father of gangster rap.  Eye witness reports make it sound bad.  Allegedly Knight hit the person, killed him and drove off.  Not good.

I love writing for Elite Daily.  It is a fun publication that doesn't shy away from provocative topics.  It has its detractors, but they mainly criticize it out of jealously.  Elite Daily gets tens of millions of unique viewers per month, and this will grow now that Daily Mail bought it.  Congratulations to its founder, David Arbov, the Elite Daily staff and the contributing writers.

Smith's chorous sounds similar to a Petty song.  Those pesky copyright laws.  Bravo to Petty for going after him.  This wasn't as bad as Hootie and the Blowfish stealing Bob Dylan's "Tangled Up and Blue" lyrics.

Social Security disability: what does it mean when a Administrative Law Judge asks you to amend the onset date?

Usually it means if your claimant agrees they win the case.  Not always but usually.  It is somewhat of a compromise in that the claimant is potentially giving up back pay, but when judges ask it usually means they are essentially telling you: "Agree or you may lose the case."  It isn't worth taking a chance.  If a judge asks you to amend the onset date, unless there is a great reason not to, do what the judge says.  Better to win than to lose.

About time.  Stone won the verdict against an agent and entertainment lawyer for unpaid royalties.  Stone was is homeless.  I'm happy for him.  He deserves it.  Glad he stuck it to these crooks, and I hope he can collect

#Snowmageddon2015, an "act of God" (force majeure)

Act of God is a common way for an insurance company to avoid paying claims.  Weather is a great example of an act of God--it is the ultimate act of God.  I've never heard of snow insurance, and I doubt anyone who has any sense would sell such insurance as that company wouldn't be in business for long. Expect there to be lots of insurance claims, but also expect insurance companies to get out of them based on the "act of God" disclaimer.  Now dumb things people do to make themselves liable, that's another question.

And it's enjoyable.  Writing is a way to get your thoughts out, and it clarifies ideas.  It also opens the chambers of your mind to reveal new ideas.  I watched and interview with Dean Koontz recently, and he said the, "Imagination is like a tool--you have to work it."  So true.  Writing helps this.  I enjoy writing on my blog, writing articles, writing stories, writing poetry and writing cartoon captions.  I learn more about myself while (hopefully) helping others.

#MLKDay reminds us the struggle continues

Martin Luther King, Jr. Day is a significant day because we are honoring Dr. King, those who have gone before him, those after and those who continue to struggle.  Although much has been achieved for people of color, racism is still a major issue.  Racism is more subtle now.  Code words are used such as "thug," "welfare queen" and other nasty monikers.  All minorities are discriminated against whether it be women (their reproductive rights even though women are the majority; they are treated like a minority), LGBT (denied the right to marry for a long time and actively discriminated against), Hispanics (denied fundamental rights and treated like second class citizens) and African Americans (discriminated against, called "thugs," killed by police much more than white people and whose right to vote is STILL infringed).  As we pause to remember this great man we should also recognize that his struggle is still our struggle.

We have a governor and a legislature who both was to keep minorities from voting.  They created the most discriminatory and restrictive voting laws in the country.  Then we reelected them and sent one of them to the U.S. Senate, the biggest buffon of them all.  Not all that different than Alabama in the 60s.

Administrative law (Social Security disability, VA disability and immigration) are vital areas of the law

Social Security disability is my main practice area, but I am taking on more VA disability cases these days.  I also have considerable experience in family based immigration law.  All three of these areas are only going to grow, and lawyers are smart to cultivate client bases here.

Immigration in particular is about to explode.  The president's new executive orders have accelerated immigration reform, and it is going to be difficult for Congress to pass laws obviating these orders.  Congress people who oppose immigration reform will feel it at the ballot box.  The party that opposes immigration reform--if the Republicans continue to do so--risks political annihilation in the future.  It is inevitable.

Wills and estates is another area where there is a huge legal need.  I draft a lot of wills, durable powers of attorney, health care powers of attorney and HIPAA forms.

Susan Ladd: Urban Ministry leaving the needy out in the cold - News#.VLUyb4q9JD4.facebook.  I don't understand the 180 day policy, which says you can't come back for 180 days after you've stayed.  I'm not even sure I understand the spirit of the rule as people can't just "pull themselves up by their bootstraps" merely by the will to do so.  Most homeless people are doing the best they can, and it isn't a question of willpower.  Believe me: I represent a lot of homeless people, and they are doing all they can to survive.

Our matter is not contained in the physical, for that is not our only measure.

Online wills--not a good idea

It is not a good idea to draft your own will.  In fact, it is a horrible idea.  What you may save in legal fees on the front end isn't worth the issues your family will deal with after you die.

Wills & estates is not an easy area.  There are significant legal formalities that must be followed.  Otherwise the will is invalid.  So many things can go wrong.  Don't be your own lawyer.  You wouldn't perform surgery on yourself would you?

Site of Jesus' trial by Pontius Pilate may have been unearthed

The ABA Journal reported this recently.  Calling it a "trial" is a stretch as it was a sham.  Rome wanted him dead and so did the Pharisees and Sadducees.  Interestingly, I read a biography on Caesar Augustus by noted Cambridge scholar Anthony Everitt, and he argued Augustus likely never knew of Jesus.  Here is the link for the article:

I #amwriting and so should you

Writing is a great release whether it be on a blog, Twitter, Facebook, a Word document or scribbling in a notebook.  I've achieved more notoriety writing on a wider scale more quickly than I ever thought possible.  It is fun, and it keeps your mind sharp.  It teaches you to clarify your thoughts and make better arguments.  Likewise, you learn to break things down to their component parts (drawing helps with this too).  By doing so, you appreciate the world around you because you can see it more broadly (50,000 foot view), but then you can appreciate its beauty (e.g. watching leaves fall).

Oklahoma wants to ban hoodies because you know that will really cut down on crime.   What a bunch of idiots.  It reminds me of when the Winston-Salem  Fox and the Hound banned white t-shirts because black people supposedly wore them and may be in gangs.  Of course this business failed, and I'm glad it did.  I wonder if they banned racist white people.  I doubt it.

This makes me want to wear one of my hoodies in Oklahoma.  I wonder if my UVA hoodie is banned too.  Oklahoma keeps demonstrating why it is a backwater.

Guy he stabbed did not die (yet).  If the guy dies, I assume he will plead self-defense, defense of others or both.  It will be interesting to see how this plays out.  He's had a rough run of it since Saved by the Bell.  Failed career.  Bankruptcy.  Now possible murder charges if the guy dies. If he had used a gun, the NRA would have called him a hero.  A patriot.
