What is a Social Security disability 1696 form?

It is the most basic of forms for Social Security disability practitioners.  It is called the Appointment of Representative form.  The purpose of the form is to tell SSA the attorney or representative represents the claimant.  It amazes me how many lawyers fail to grasp the importance of this form and to fill it out in a timely fashion.  When you don't have this form, 1) you can't represent the claimant, and 2) you look like an incompetent attorney.  Get the form.  Fill it out.  Have your client.  Sign it--sign it twice.

Estate Planning for Equality a success for LGBT couples

On Saturday, October 25th, the North Carolina Bar Association Young Lawyers Division, in conjunction with the Campaign for Southern Equality and OUTLAW held an estate planning documents drafting event at Wake Forest University School of Law.  Close to 50 LGBT individuals received their documents for free, and over 25 lawyers, law students and paralegals helped with the project.  It was the first of its kind, and there will be more to follow.  I enjoyed helping this group, a group that has been and continues to be discriminated against.

If you think the legislature wants more people to vote, you are an idiot.  It takes too long and is too cumbersome.

This is what happens when you have restrictions on early voting and voter ID.  Wait should be an hour, but there are campaigns telling certain demographics it will take them two hours.  Now who would do that?  Take a guess.

90 day fiancé is a ridiculous show

I've drafted forms and filed for so-called "fiancé visas".  They are K-1 visas, and you are required to marry within 90 days of entering the United States.  Otherwise the visa will be revoked.  A marriage that lasts less than two years is deemed a "sham marriage" meant to curcumvent the immigration system.

90 Day Fiancé is a stupid show.  Lots of mail order brides.

On September 8th, 2014 SSA changed its Social Security disability rules regarding video conferencing

Claimants can opt to appear in person only or via video conference.  The video conference will still be at a hearing office, but the judge will be in a remote location.  Claimants have 30 days from the date they receive the notice t object and request a live hearing.

There is no reason to object to a video hearing as the judge will see you through the TV screen anyway.  Substantively I don't see much of a difference between a live hearing or a video hearing.  Objecting, however, and demanding a video hearing may delay when your hearing takes place.

YLD Estate Planning for Equality to draft documents for LGBT community

People who meet certain requirements will be able to get wills, health care powers of attorney, durable powers of attorney and living wills for free.  The goal of the program is to provide these documents for the LGBT community.  Other groups, however, will not be turned away.  It will be nice to help the LGBT community, which is so often discriminated against.  Marriage equality is coming though.

SCOTUS passes on same-sex marriage case

My writing biography


Michael graduated from the University of Virginia in 2001 with a BA in history. He graduated from Wake Forest University School of Law in 2004. Michael practices in the areas of Social Security disability, VA disability, general civil litigation, immigration and wills & estates. He is active in the North Carolina Bar Association (NCBA), where he serves as the Chair of the Young Lawyers Division. In addition to the NCBA, Michael has served in leadership positions with the American Bar Association (ABA).

Super Lawyers Magazine has named Michael a “Rising Star” in 2010, 2011, 2012 and 2013. Business North Carolina Magazine has named Michael one of its “Young Guns” for 2011,2012, 2013 and 2014. Both of these publications are voted on by lawyers in North Carolina.

Michael has also provided television legal commentary for WXII, WFMY and Fox 8. He writes a blog,www.southernlawyernc.blogspot.com, where he writes about the law and legal news. The blog receives between 300-400 hits per day. He is also active on Twitter @slnc01 where he has a few thousand followers. He tweets about law related topics ranging from the law to literature to Star Wars.

And it could have been stopped.  Since the 4th Circuit stayed a great deal of the voting law, the Board of Elections needs to issue corrected literature.  Somehow I bet they will act slowly.
