Is Sherlock ‘complete’? 7th Circuit will consider when literary characters are free from copyright. This is fascinating. Many of the stories in the Sherlock cannon, 50 in fact, are no longer under copyright protection. The issue is whether the characters themselves are free from copyright protection? If they are, then the authors who are using the characters must pay licensing fees. As an avid Star Wars fan, I know the characters are copyrighted and trademarked (the likenesses are). Most of the money was made in the merchandising which includes my favorite--the books.
