DOJ says bar officials violate ADA by asking applicants too much about their mental health. It's about time. I've always thought bar exam applications were too intrusive. Mental health should be off limits. I understand lawyers have a higher rate of alcoholism, substance abuse and mental health issues, but that doesn't mean you surrender your privacy just to become a lawyer. Indeed, that would be ironic. Likewise, most state bars are quasi-governmental entities, and the right to privacy attaches or at least the argument can be plausibly be made.
